1. Question regarding my I-94 form...
I have one which I got when entered US, 4 yrs back which is expired and after that I got new ones with each H1B application extension.
Should I send all of them or just the latest one? or the one i got while entering (Expired one)
2. Is it possible to travel on old AP While applying for EAD and AP renewal?

Well, that is certainly frustrating! Your best option would be to get in touch with the designated Application Support Center to see if they can either notify the USCIS Service center of the error or have your daughter come in right away for fingerprinting. ASC phone numbers are generally not made public, but in many locations, ASC staff has provided local immigration attorneys with a phone number to use for urgent or unusual situations such as yours.
If you don't have an attorney who can call the ASC for you, you might consider just going to the ASC in person with your daughter to explain the situation and ask for their assistance.

the fact that you move using AC21 and use EAD for work nullifies your H1 immediately and the dependents lose H4. even the date on I-94 becomes meaningless.
you will have to renew your EAD for work and AP for travel.
The fact that your I-485 is pending is all that is needed to keep you legal. But if for any reason I-485 is denied you will be out-of-status.

I recently applied for a PAN Card. Got a DD through my parents in India and sent the form. Today they sent a mail with following --
1) We are yet to receive payment for application.- Kindly e-mail Cheque /DD no. and date on which amount has been debited from your account
2) Photograph provided is not proper for scanning.
Have any one faced similar problem ? A valid DD was included and they say they did not receive the payment ?? Also, the photo was of right size and clear enough so I am not sure what else to do.
Any help will be greatly appreciated
check with your bank whether they cashed the DD. tell them DD is lost - they might cancel old one & issue new one.

I am currently residing in US on H-4 visa. My husband is on H-1 visa and our Green Card processing is in progress - our
I-140 has been approved. Our priority date is in May 2008.
The current "priority dates" for EB-3 as per USCIS is April-2001. Based on this, When can we expect our "485" to be filed and our EAD to be approved ?
I have a law degree from India (12+3+3) and currently I am pursuing a paralegal program from an ABA approved university. I might loose my job oppurtunities if I don't have a work permit. Is there anyway that I can get a work permit with my pending GC application process, without hampering the GC process ? Can I get a work visa (or EAD) based on my education ?

Hi Guys
I went to local USCIS office today and asked about my case status. My I-485 was filled on 08Feb07 in EB2 category. A lot of people who have fillled I-485 after me, have already received green cards.
The Immigration lady was very nice and she told me that my case can not be approved as my name check is still pending with FBI. The name check was initiated on 24Feb07. She created a service ticket for me providing a target date of middle of next month. The ticket said that "Please approve asap after getting clearance from FBI". I do not know what does that mean? Still trying to figure out???
Then I asked about name check status of my dependants. She mentioned that their name check has been resolved which is different from cleared. She created a different SR for my dependants requesting Approval of Green cards as name check has been resolved again giving me mid of next month as target date. Does it mean that my depandants can get approval before my approval?
Gurus Any idea what should I expect. Do I need to continue to follow up with FBI and senators regarding my name check and collecting information for case file?

My wife applied for her H4 visa this month and when she got to the embassy for the interview, the consul checked and commented on the font size of her address in our marriage certificate. She said it was smaller than my address (well, she got a longer address before we got married, maybe that is why the census made it smaller) and said to my wife that it needs verification. The embassy then took all documents (her passport, our original marriage cert, etc.) and said they will call her when she needs to return for interview again.
Has anyone of you experience this? If so, any ideas how long it takes for them to call? BTW I'm Filipino. Thank you guys and God bless

Hello motivated,
you can search some good online universities to join her and change her status to F1.She can do MBA or Masters through some accredited online university,so that she can attend classes online no need to go anywhere.
If you try in this route she can get her CPT/OPT so that she can work,
and will achieve masters degree finally,which will help to find a sponsor easily.
If u want to persue that job which is offering you bright future,may be this is the option u can use to maintain the status of your wife.

I need your expert opinion.
While setting up an appointment through VFS for H1B stamping in Mumbai, I am asked the following question:
Are you applying for the same class of visa which is currently valid or has expired within the past 12 months?
Should I answer Yes or No? I guess the answer is Yes since I have a valid I797 H1 approval. But, I need expert opinions from you guys as well. Here is some background:
I have H1 visa stamp through my old employer "O" (with an expiry of March 2006). I changed employer "X" in Nov 2003. My H1B has also been renewed in Nov 2006 (with "X"). i.e. I have had two valid I797 H1 approval notice with "X" since Nov 2003 - one for change of employment through my current employer from Nov 2003 to Nov 2006 and then a renewal from Nov 2006 to Nov 2009 (this is currently valid). I have not been to India since July 2003.
Please advise what the answer to the questions above. Also, is this visa stamping considered a renewal since my old visa stamp is through my old employer?

Foreign nationals who have stayed in the United States after the expiration of their period of authorized stay or are present in the United States without being admitted or paroled are unlawfully present in the U.S.
If more than 180 days but less than a year of unlawful presence accrues, then the foreign national is inadmissible for three years (three year bar). Foreign nationals who are unlawfully present for one year or more are inadmissible for 10 years (10 year bar). If a foreign national has accrued unlawful presence in the United States, then they are deemed inadmissible and illegible to re-enter the U.S. for either the three year or 10 year bar from the date they leave the U.S.
There is a waiver available for the unlawful presence ground of inadmissibility. Essentially the waiver will waive the three and 10 year bar of inadmissibility. The waiver is only available to foreign nationals with a U.S. citizen or lawful permanent resident (LPR) spouse or parent. Children are not deemed qualifying relatives for the waiver. The first step in the waiver process is for the foreign national to attend an immigrant visa consular interview in their home country. Once the consular officer deems the foreign national is inadmissible and a waiver is available, the foreign national will then file the waiver (form I-601, with the applicable filing fee) and establish there is extreme hardship to the U.S. citizen or LPR spouse or parent if the foreign national were not allowed to return to the United States. The waiver request is discretionary and extreme hardship is only one factor the officer will consider.
Certain individuals do not accrue unlawful presence and are not subject to the three or 10 year bar. For instance, foreign nationals under 18 years of age do not accrue unlawful presence.
