I, a July 2 filer, got receipts last week. EADs came on the weekend. No APs yet. Seems like USCIS is still very much backlogged. Taking infopass etc is unlikely to help much. Best is jus wait for another 2-3 weeks. Best of luck...

Guys,
Can someone please let me know whether it is possible / advisable to travel while H1 approval is pending?
She is currently in H4 with a valid stamp in her passport. She filed for her H1 and was selected in lottery. She has a receipt but her approval is pending.
We were interested in making a short trip to India before Oct 1. But the consulting firm advised against it as according to them if she re-enters in H4 (even before Oct 1) while her H1 approval is pending, her H1 application will be cancelled and she has to restart the process all over again. Something to do with the last status on re-entry.
My thoughts are: The change of status will be effective Oct 1, 2008, why would it matter if I travel prior to that date?
A lot of you may have experienced the same dilemma, so please let me know...

I am not sure if someone is in same situation.For my I140 it says the following
Current Status: Document mailed to applicant.
On April 1, 2009 we mailed the document to the address we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service.
I am not sure what does this mean. If some one can throw some light.

Hello all,
I am a student on an I20/M1 vis
I have just recieved a new I20, and sent a form I 539 for extension of my I20.
I have my old I94, I20 etc.
It is currently under processing.
First, is there any way they can move it to another processing center? Its in the vermont center right now, and they are still processing documents from May 2008 according to CIS website.
Second, my original I94 is valid till 14 April 2009 but my original I20 is expired.
My visa is 5 years(M1 valid to 2013)
Can I go and visit my home country with the old I94(since its valid long enough) and new I20(which just got issued)??
or do I need to wait until the processing comes through?

I think as long as you have valid visa and new I-20 you should be fine.
These questions are easily answered by school officials. Get a apointment and get a quick answere from your International student office.

I am currently working on H1B and have received my EAD and Advance Parole recently. I am planning to travel next month and want to use
my Advance Parole for this purpose. When I come back (to avoid h1b stamping again in home country). Do I need to use EAD to continue

Hi,
My pending I-140 (filed an year ago...June 2006) was transferred from TSC to NSC on 09/05/2007, because my I-485 was filed with NSC. What date willl NSC use as received date to process my case...the date they received from TSC or the original receipt date?
Isn't it(140 filed at TSC almost an year ago) supposed to be certified by now?
TSC has been much faster at certifying 140s . Looks like USCIS is transferrring the 140s from TSC ... I can only pray for alll concurrent fileres that filed at TSC ...

I�m in EB2 and My I-140 was approved on March 2009 through Employer A. After which I moved to India and now am back (Nov 2010) with Employer B. My old Employer A has my apporved I-140.
It would be great if I get answer the below my Question:
1. Can I apply for I-485 with my new employer B based on my approved 140?? OR
2. Do I need to go back to my old employer A to apply my I-485. If yes is there any specific time period to go back to my old employer A.

I start to study WOM, my district court web doesn't list anything about that, then I find aonther site lists WOM cases filed in my district, but no status mentioned. Does anyone knows? I appreciate!

In general, AP is not related to employment (it is a conditional admittance aka parole into US boundaries till the conditions are resolved), so the PoE CBP should not ask about employment. However, as your husband has been away for a long time, the CBP officer may be curious to know why and what is the purpose of entering US after such a time lag.
In such a scenario, your husband should have a strong reasoning as to why he is entering US. Some of such reasons are a) employment b) having immediate family in US or c) owning house/property that needs visitation.
If your husband has one such reason, it may be helpful to gain entry into US, but pl do consult your lawyer...good luck

I have got my wife passport stamped(H4) until Oct'09 based on my previous H1. I have changed company and got new I-797 for both of us valid till Apr'2010. During her recent visit to India and return to USA, at the port of entry she was issued I-94 till Oct'2009 eventhough her I-797 form my new employer is valid till Feb'2010.
I don't want to ask my wife to cross the broder (@Mexico or @Canada) for the sake of renewing her I-94. I am wondering if I can apply with USCIS for her extension of I-94 till April'2010 for which she has I-797 to support it.

Can you walk in for un-scheduled apointment? ... Now days this might not be permissible, but I remember 5 yrs ago at Toronto consulate, after all scheduled applicants have been lines up timewise, un-scheduled applicants were asked to form line behind on first come first basis. Not sure if anyone got chance, as I was like most lined up ahead in scheduled lineup. But wonder if it is still permitted, how about taking chance?

Just make the switch,,thats it! Its that simple!! Make sure when u join the new company they file your perm asap and when u r in the 140 stage, you could work with your lawyer to port your old PD. AC21 has made life better!
There are two ways :-
a) Get your H1 transferred and join a new company. You need to complete your new PERM and I-140 before Mar'08 to get your next extension. In this case, you cannot carry over your PD.
b) Wait for your I-140 to be approved. Once it is there, move on, and file your PERM/I-140. You should be able to get your next extension based on the approved I-140 unless it is revoked. Also, you can start your PERM in parallel while waiting for I-140. You can speed up your I-140 by moving it to PREMIUM processing - it involves another 1000 $ of cost. This way you can carry on your PD if you can get a copy of the I-140 when you leave.
There would be other ways too - folks here can enlighten you on the same and if there are any corrections in what I suggested you, they would gladly do it.
